  1.                  MAC-INSANITY BBS RULES & CONDITIONS OF USE
  2.  
  3.   ATTENTION: 
  4.   It is a criminal offence to supply a false name, and you are committing 
  5.   fraud if you do so. You may think that you will get away with doing so, 
  6.   but you will be suprised to find that 99% of people are caught. 
  7.  
  8. When using this system, you agree to the following rules and conditions of use:
  9.  
  10.  1. "SYSOP" refers to the System Operator of The Mac-Insanity  
  11.  (N. Marburg) & (S. Marburg) and is Assistants or deputies as 
  12.  appointed from time to time.
  13.  
  14.  2. "MAC-INSANITY BBS" refers to the electronic database system
  15.  which you wish to register with.
  16.  
  17.  3. Information that would compromise the national security of the
  18.  Commonwealth of Australia is prohibited.
  19.  
  20.  4. Information that violates proprietary rights or personal privacy
  21.  is prohibited.
  22.  
  23.  5. The use of Mac-Insanity you will in no way or manner
  24.  constitute any obligation for the Sysop to provide you with
  25.  services. Contractual rights are expressly denied. The Sysop of
  26.  Mac-Insanity bbs and you have no form of contract whatsoever.
  27.  
  28.  6. Mac-Insanity BBS attempts to encourage the free exchange of ideas,
  29.  opinions, thoughts and information, except where usage of this
  30.  system would violate any International, State, Federal or Local
  31.  Government law or regulation affecting telecommunications, or
  32.  where such action constitutes a criminal or libelous act.
  33.  
  34.  7. You are obligated to inform the Sysop of your real name and to
  35.  disclose any personal or pecuniary interest when evaluating any
  36.  product or service.
  37.  
  38.  8. You explicitly acknowledge that all information obtained from
  39.  MAC-INSANITY BBS is without any warranty of any kind, either
  40.  expressed or implied, but not limited to the implied warranties
  41.  of merchantability and fitness for a particular purpose and that
  42.  the entire risk of acting on such information obtained from
  43.  MAC INSANITY BBS, including but not limited to the entire costs of
  44.  any necessary remedies, belongs to those who supply such
  45.  information and not to the Sysop of MAC-INSANITY BBS.
  46.  
  47. 9. Donations towards the running costs of MAC-INSANITY BBS are gifts.
  48.  They will not be construed as forming any contractual agreement
  49.  whatsoever between the donor and MAC-INSANITY BBS or its Sysop.
  50.  
  51. 10. Further more you are to explicitly acknowledge that all electronic
  52.  mail posted on MAC-INSANITY BBS is to be considered the copyrighted
  53.  works of the author, and that permission to reprint in part or in
  54.  whole must be obtained from the author of the message and
  55.  notification made in writing to the Sysop of your intentions. All
  56.  views expressed in said electronic mail are not to be considered
  57.  to be those of the Sysop in any way form or manner except where 
  58.  said message is posted and signed by the Sysop.
  59.  
  60. 11. Further more you are to acknowledge that from time to time a user
  61.  of MAC-INSANITY BBS may inadvertantly upload Commercial Software.
  62.  Every attempt will be made to remove the offending Software from
  63.  the BBS within a reasonable amount of time.  You understand that
  64.  this may take several days to happen and you agree to refrain from
  65.  taking any action over the matter until the Sysop of the BBS has
  66.  had a reasonable amount of time to remove the offending programme
  67.  from the system.

  69. 12. You are to acknowledge that all Public Domain Software is to be
  70.  considered the Copyrighted works of it's Author and as such may
  71.  not be used and or sold in a commercial environment without prior
  72.  permission of the Author of that piece of Software.
  73.  
  74. 13. Trying to "hack" the system is definitely anti-social & now under
  75.  Victorian Law is also considered to be a criminal act.  I'll know
  76.  if you try and appropriate action will be taken.
  77.  
  78. 14. Don't use abusive or offensive language in any of the message
  79.  areas.
  80.  
  81. 15. Use of any of the message areas for any purpose which contravenes
  82.  any law, State, Federal or International, is prohibited.
  83.  
  84. 16. Under no circumstances is the uploading of commercial or "pirated"
  85.  software permitted.
  86.  
  87. 17. The Sysop of MAC-INSANITY BBS will not interfere with the content of
  88. any message posted on the BBS, unless that message should
  89.  contravene any of the aformentioned conditions.  If you have a
  90.  legitimate complaint about the content of any message or file the
  91.  Sysop agree's to review said message and take such action as is
  92.  deemed appropriate without infringing on the rights of other users
  93.  of the System to express themselves using thier legal right to
  94.  Freedom of Speech.
  95.  
  96. CONDITIONS OF USE. 
  97. As a registered user of this system, you are obligated respect the following:
  98.  
  99. (a) I am an interested user of this system, using it only for my own
  100.  personal interest and amusement.
  101.  
  102. (b) I have given the System Operator (Sysop) my real name, and if
  103.  applicable, a pseudonym by which I may be known.  I shall not
  104.  permit any other person to use that pseudonym and/or access
  105.  number.  I acknowledge that the use of such combinations of
  106.  electronic passwords shall have the effect as if my common
  107.  signature was applied to a document.
  108.  
  109. (c) I agree that this system is Private, and my presence here is at
  110.  all times at the discretion of the Sysop, whose descision on such
  111.  matters of access shall be final and binding.
  112.  
  113. (d) The access of MAC-INSANITY for the
  114.  express purpose of assessing the content for possible breach of
  115.  any regulation shall be deemed to be an act of entrapment, and as
  116.  such shall be considered to be an act giving rise for a complaint
  117.  pursuant to the Compter (Crimes) Act 1989.
  118.  
  119. (e) Such access as described in (d) above shall also be regarded as a
  120.  breach of the common law right of privacy of Communication as laid
  121.  down by Commonwealth statute, and shall also be deemed to be an
  122.  illegal interception of a communication, and shall give rise to a
  123.  complaint for an action under the Federal Telecommunications Act.
  124.  
  125. (f) Donations towards the running costs of MAC-INSANITY are gifts.
  126.  They are not to be considered as forming any contractual agreement
  127.  whatsoever between the donor and MAC-INSANITY or its Sysop.
  128. (g) Supplying a false name will be treated as an act of fraud, and will
  129.  be persuable under the relavant act.
  130.  
  131. SEVERE PENALTIES APPLY FOR THE INTERCEPTION AND UNLAWFUL ACCESS TO
  132. PRIVATE DATABASES, THIS BBS IS DEEMED TO BE A PRIVATE ONLINE DATABASE,
  133. SECURED AND REGULATED BY THE REGISTERED SYSOP.
  134.
